(以下故事均由真實案例改編)
“無證上崗”的旅游達人
F國小伙Leo是個資深旅游達人,一次持旅游簽證來中國旅游過程中,偶然得知某“國際”私立學校招聘外教,便抱著“小試牛刀”的心態去應聘,成功成為該學校的一名外語教師,結果被移民管理警察查獲。Leo被處以五千元罰款,聘用Leo的學校也被罰款一萬元。
《出境入境管理法》第四十一條第一款
外國人在中國境內工作,應當按照規定取得工作許可和工作類居留證件。任何單位和個人不得聘用未取得工作許可和工作類居留證件的外國人。
《出境入境管理法》第八十條第一款
外國人非法就業的,處五千元以上二萬元以下罰款;情節嚴重的,處五日以上十五日以下拘留,并處五千元以上二萬元以下罰款。
“一心多用”的留學生
J國留學生Luke獲得學習簽證后并沒有去學校上課,而是受聘到一家商業機構負責英語教材銷售。商業機構將他派遣到5個幼兒園去上課,每月可以領8千元的工資。正當Luke做著發財的美夢時被移民管理警察查獲,被處行政拘留十日并處罰款一萬元,聘用他的商業機構及幼兒園均被處以罰款一萬元并沒收違法所得。
《出境入境管理法》第四十三條
外國人有下列行為之一的,屬于非法就業:(一)未按照規定取得工作許可和工作類居留證件在中國境內工作的;(二)超出工作許可限定范圍在中國境內工作的;(三)外國留學生違反勤工助學管理規定,超出規定的崗位范圍或者時限在中國境內工作的。
《出境入境管理法》第八十條第三款
非法聘用外國人的,處每非法聘用一人一萬元,總額不超過十萬元的罰款;有違法所得的,沒收違法所得。
“自作主張”的團體領隊
一W國表演團體10名外籍演員到S省進行舞蹈演出,經申請依法獲得省文化廳的表演批復和外國人短期工作證明,但演出許可范圍僅限Y市。為了增加收入,團體領隊私自聯系中介增加了同省N市的一場演出,卻在演出時被移民管理警察發現,該演出團體及中介各被處以五萬元罰款并沒收違法所得。
《出境入境管理法》第四十三條
外國人有下列行為之一的,屬于非法就業:(一)未按照規定取得工作許可和工作類居留證件在中國境內工作的;(二)超出工作許可限定范圍在中國境內工作的;(三)外國留學生違反勤工助學管理規定,超出規定的崗位范圍或者時限在中國境內工作的。
《出境入境管理法》第八十條第二款
介紹外國人非法就業的,對個人處每非法介紹一人五千元,總額不超過五萬元的罰款;對單位處每非法介紹一人五千元,總額不超過十萬元的罰款;有違法所得的,沒收違法所得。
“鍥而不舍”的“全村希望”
Peter是一名L國留學生,家鄉人民對他寄予厚望,他卻在追求個人物質享受的過程中無法自拔。學習期間,他通過網絡找到了一份兼職工作,拿著每月6千多元的工資,小日子過得美滋滋。然而“好景不長”,很快就被移民管理警察發現,被處以罰款并處限期出境。被處罰后Peter心有不甘,并未按要求在規定時間出境,而是悄悄“重操舊業”,一個月內再次被查獲,行政拘留15日后被遣送出境,三年內不準入境。
《出境入境管理法》第六十二條第一款、第三款
外國人有下列情形之一的,可以遣送出境:(一)被處限期出境,未在規定期限內離境的;(二)有不準入境情形的;(三)非法居留、非法就業的;(四)違反本法或者其他法律、行政法規需要遣送出境的。
被遣送出境的人員,自被遣送出境之日起一至五年內不準入境。
“偷梁換柱”的表演團隊
一R國表演團體組織30名演員到N市進行交響樂演出并依法獲得演出許可。表演前,移民管理警察對演出團隊演員證件資質進行審查時發現,演出名單上竟有20名演員被“偷梁換柱”,另外10名演員中有9人持用的是旅游簽證,只有1名演員合規,其余演員均不符合演出要求。面對如此“不靠譜”的表演團隊,移民管理警察當即叫停了他們的演出。
《外國人入境完成短期工作任務的相關辦理程序》第四條
入境進行短期營業性演出的外國文藝表演團體、個人應持有文化主管部門出具的批準文書及在中國短期工作證明;入境完成其他短期工作任務的,應持有人力資源社會保障部門頒發的外國人就業許可證書及工作證明。

Leo, came to China with a tourist visa and started working for a school as a foreign teacher without working permit. Immigration department noticed this and arrested him. Leo was fined 5000 yuan and the school that employed him was fined 10000 yuan.
Article 41 (1) of the law on the administration of exit and entry
Foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations. No entities or individuals shall employ foreigners who have no work permits or work-type residence permits.
The administrative measures for foreigners working in China shall be stipulated by the State Council.
Article 80 of the exit and Entry Administration Law
Foreigners who work in China illegally shall be fined not less than RMB 5,000 but not more than RMB 20,000 yuan; where circumstances are serious, they shall be detained for not less than five days but not more than fifteen days and shall also be fined not less than RMB 5,000 yuan but not more than RMB 20,000 yuan.
Persons who introduce jobs to ineligible foreigners shall be fined RMB 5,000 yuan for each job illegally introduced to one foreigner, with a cap of not more than RMB 50,000 yuan in total; and entities that introduce jobs to ineligible foreigners shall be fined RMB 5,000 yuan for each job illegally introduced to one foreigner, with a cap of RMB 100,000 yuan in total; and the illegal gains, if any, shall be confiscated.
Individuals or entities that illegally employ foreigners shall be fined RMB 10,000 yuan for each illegally employed foreigner, with a cap of RMB 100,000 yuan in total; and the illegal gains, if any, shall be confiscated.
Working with Student visa
Luke has a Chinese student visa but decided to work without work visa. Luke was dreaming of making a fortune, he was arrested by the immigration police and was detained for 10 days and fined 10,000 yuan. kindergartens that employed himwere fined 10,000 yuan and his illegal income was
confiscated.
Article 43 of the exit and Entry Administration Law
Any of the following acts of foreigners shall be deemed unlawful employment:
(1) Work in China without obtaining work permits or work-type residence permits in accordance with relevant regulations;
(2) Work in China beyond the scope prescribed in the work permits; or
(3) Foreign students work in violation of the regulations on the administration of foreign students working to support their study in China and work beyond the prescribed scope of jobs or prescribed time limit.
Performing Artist
Group of foreign dancers was checked by the immigration police and noticed that only one of them have legal document to work. They were fined 50000 yuan and their illegal income was confiscated.
Article 43 of the Exit and Entry Administration Law
An alien who commits one of the following acts shall be considered as illegal employment: (1) working in China without obtaining a work permit and work residence certificate in accordance with the provisions; (2) working in China beyond the scope of work permit; (3) foreign students who, in violation of the regulations on the Administration of work study assistance, work in China beyond the prescribed post scope or time limit.
Peter is an international student from China he found a part-time job through the Internet, with a monthly salary of more than 6000 yuan, However, it did not last long. The immigration police arrested him and ordered him to leave the country within a time limit. After being punished, Peter didn't leave the country at the required time. Instead, he quietly "went back to his old business" and was arrested again within a month. After 15 days of administrative detention, he was deported and was not allowed to enter the country for three years.
Article 62 of the law on the administration of exit and entry
Under any of the following circumstances, foreigners may be repatriated:
(1) Are ordered to exit China within a prescribed time limit but fail to do so;
(2) Are involved in circumstances in which they are not allowed to enter China;
(3) Illegally reside or work in China; or
(4) Need to be repatriated for violation of this Law or other laws or administrative regulations.
Other overseas personnel who fall under any of the circumstances prescribed in the preceding paragraph may be repatriated in accordance with the law.
Repatriated persons shall not be allowed to enter China for one to five years, calculating from the date of repatriation.
Article 4 of the relevant procedures for foreigners to complete short-term tasks upon entry
Foreign performing groups and individuals who enter the country for short-term business performances shall hold the approval document issued by the competent department of culture and the short-term work certificate in China; those who enter the country to complete other short-term work tasks shall hold the foreign employment permit certificate and work certificate issued by the human resources and social security department.
